1. Acceptance of Terms

By accessing or using theBouquet, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

theBouquet is a free web application that allows anyone to create personalized digital bouquets with heartfelt messages and share them with others via unique links or downloadable QR codes. No account or registration is required.

Those who purchase a Premium Pass — via Ko-fi or, for Philippine supporters, via PayMongo — become recognized as supporters and receive a unique unlock link as a thank-you gesture, which grants access to exclusive assets. Supporter access lasts for 1 month, 3 months, or 1 year from activation depending on your chosen tier. Legacy supporters who unlocked access prior to April 9, 2026, retain permanent access. Offering resource-intensive features—such as voice messages, email delivery, and custom image uploads—as exclusive rewards helps us prevent spam abuse and ensures the financial sustainability of the platform.

To ensure fair access for all visitors, bouquet creation is subject to a daily limit per visitor. Free visitors may create up to 5 bouquets per day. Supporters receive a higher limit of 30 bouquets per day as a thank-you for helping sustain the service.

3. User Content & Custom Uploads

You retain ownership of the bouquets and messages you create. By making a bouquet public, you grant theBouquet a non-exclusive, worldwide, royalty-free license to display it in the Showcase gallery and use it for any marketing and promotional purposes related to the service.

You are solely responsible for the images, text, and content you upload and attach to bouquets on this service. By uploading an image, you confirm that you own the rights to use that image and that it does not violate copyright laws. theBouquet reserves the right to remove any bouquet or block any upload at its sole discretion without notice.

You agree not to create content that:

• Is illegal, harmful, or offensive.
• Infringes on the intellectual property rights of others.
• Contains spam, malware, or phishing attempts.
• Impersonates another person or entity.

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or to violate any laws.
• Attempt to gain unauthorized access to the service or its systems.
• Interfere with or disrupt the service or servers connected to it.
• Use automated means (bots, scrapers) to create bouquets or access the service without permission.
• unauthorized access to supporter perks, or generating fake unlock tokens without purchasing a pass.
• Attempt to circumvent daily bouquet limits, including by masking, rotating, or spoofing your IP address to exceed the allowed daily quota.

5. Email Delivery and Voice Message Features

theBouquet provides optional features that allow supporters to send bouquet notification emails and attach voice messages. By using these features, you agree to the following:

• You are responsible for ensuring that the recipient’s email address you provide is correct and that you have a legitimate, good-faith reason to contact them.
• You must not use this feature to send unsolicited, harassing, or unwanted emails to any person.
• You are responsible for the legality and appropriateness of voice recordings you upload, including obtaining consent where required by applicable laws.
• Voice messages must not contain illegal, threatening, harassing, defamatory, or rights-infringing content.
• Recipient email addresses are used solely to deliver the bouquet notification and are not stored, retained, or used for any other purpose.
• Voice message files are stored to provide playback through the bouquet link. Technical limits (such as duration and file size) may be enforced for platform safety and reliability.
• Voice message duration is currently limited to around 2 minutes and may change as the product evolves.
• Rate limiting is enforced to prevent abuse. Attempts to circumvent these limits are a violation of these terms.
• theBouquet sends emails on your behalf as a technical intermediary. You, as the sender, bear full responsibility for the content and intent of any message delivered through this feature.

6. Anonymous Use

theBouquet does not require account registration, and you may create and send bouquets anonymously or under a chosen display name. However, anonymous use does not exempt you from these Terms of Service or from applicable laws.

• You remain fully responsible for all content created and all emails sent during your session, regardless of whether you identify yourself.
• You must not use anonymity to harass, threaten, or impersonate any individual or entity.
• theBouquet reserves the right to restrict or block access to the email delivery feature or any other part of the service in response to suspected abuse, without prior notice.

7. Content Deletion & Retention

To maintain server sustainability, theBouquet enforces a 14-day (2-week) retention limit on digital bouquets created by non-supporters. Free bouquets expire after 14 days. Once expired, the bouquet image is removed, but the letter/message stays accessible through the original link unless you request deletion.

Supporter bouquets have no fixed expiration date. As long as theBouquet remains operational and financially sustainable — which your support directly helps ensure — supporter bouquets will remain accessible, giving your loved ones a lasting keepsake. This is not a perpetual guarantee; if platform conditions ever require a change, we will provide advance notice before any expiration policy applies to existing supporter bouquets.

theBouquet reserves the right to remove any bouquet or content that violates these terms at any time without notice.

8. Service Availability

theBouquet is provided “as is” and “as available.” There is no guarantee that the service will be uninterrupted, secure, or error-free. theBouquet reserves the right to modify, suspend, or discontinue the service at any time without notice.

9. Premium Passes and Supporter Perks

Purchasing a Premium Pass through Ko-fi is a voluntary way to support the development and hosting of the platform. Perks are exclusive digital rewards unlocked as a thank-you for your pass purchase. Supporter access lasts for your chosen duration (1 month, 3 months, or 1 year). Legacy supporters who unlocked access prior to April 9, 2026, retain permanent access. Contributions are non-refundable, as they go toward immediate hosting and infrastructure costs.

Philippine supporters may alternatively pay via PayMongo. The same supporter perks, selected access duration, and non-refundable policy apply. Payment processing is automated, and your unlock link will be delivered via email upon successful payment.

• theBouquet reserves the right to modify, add, or remove supporter perks at any time.
• Supporter perks currently include: exclusive flowers, wrappers, and templates; voice messages; email delivery; custom image uploads; an increased daily bouquet limit (30/day); and no fixed expiration on your bouquets — they stay up for as long as theBouquet is running and sustainable.
• Supporter status is stored in your browser and is not transferable.
• Supporter unlocks expire after your chosen tier's duration. Legacy supporters who unlocked access prior to April 9, 2026, retain permanent access.
• Supporter unlock links are strictly for personal use by the individual. Sharing, distributing, or publishing your unlock link is a violation of these terms and may result in your access being revoked.
• Supporters receive an increased daily bouquet limit (30/day) compared to free visitors (5/day). This limit is subject to change.

10. Disclaimer of Warranties & Limitation of Liability

Please read this section carefully as it limits our liability.

The service is provided on an "as is" and "as available" basis. theBouquet expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, theBouquet and its creator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of data, loss of profits, or service interruptions.

theBouquet acts strictly as a technical intermediary and is not responsible for any misuse of the email delivery, voice messages, custom uploads, or anonymous sending features by users, including any harm, emotional distress, or damages caused to third parties as a result of such misuse.

11. Indemnification

You agree to indemnify, defend, and hold harmless theBouquet and its creator from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your use of the service, your User Content, or your violation of these Terms of Service.

12. Copyright & DMCA Policy

theBouquet respects the intellectual property rights of others. If you believe that your copyrighted work has been copied or uploaded to our service in a way that constitutes copyright infringement, please contact us immediately at the support email below with a detailed takedown request. We reserve the right to remove any content alleged to be infringing without prior notice and at our sole discretion.

13. Changes to These Terms

theBouquet may update these Terms of Service from time to time. A notice will be posted on the site for any significant changes. Continued use of the service after changes constitutes acceptance of the new terms.
